Join Duke Law Professor Lisa Kern Griffin for a conversation about the gap between truth and honesty in the criminal justice system, and how the courts may shed some light on the challenges of a "post-truth" public discourse. Focusing on "lying" is a natural response to uncertainty but too narrow of a concern. This discussion will address why honesty and truth are not the same thing, and how conflating them can actually inhibit accuracy in criminal investigation and adjudication. In this engaging presentation, Professor Griffin will consider examples from police interrogations, plea bargaining, defendant testimony, cross examination, and forensic expertise.
